Are countdown timers illegal in the EU? UCPD Annex I, explained

If a product countdown timer resets when the page reloads, the urgency it advertises is false. UCPD Annex I point 7 lists false impressions of limited availability as a blacklisted practice. Intent is not required.

Countdown timers are not illegal in the EU on their own. A countdown timer becomes illegal when the urgency it advertises is false. The Unfair Commercial Practices Directive 2005/29/EC contains a blacklist at Annex I. Items on that list are unfair in all circumstances. No intent is required. No consumer harm has to be demonstrated. The practice is per se unlawful.

Falsely stating that a product will only be available for a very limited time, or that it will only be available on particular terms for a very limited time, in order to elicit an immediate decision and deprive consumers of sufficient opportunity or time to make an informed choice.

Why do resetting countdown timers trigger UCPD Annex I?

A countdown timer on a product page advertises a deadline. If the timer resets to its starting value every time the page is reloaded, no deadline exists. The displayed urgency is a fabrication. The UCPD does not ask the merchant whether they meant to deceive. It asks whether the impression conveyed is false.

The same logic applies to global site banners ("Sale ends in 03:42:11") that reset at midnight every day or that reset on every new session.

Real enforcement on countdown timers and fake scarcity

ApplicationItaly, AGCM, 2023, decision PS12106: action against a fashion marketplace for repeated use of resetting timers and "only X left in stock" banners that did not reflect actual inventory. Fine of 600,000 euros.

ApplicationPoland, UOKiK, 2024: ongoing proceedings against several Allegro third-party sellers using the same pattern, with provisional liability findings.

ApplicationHungary, GVH, 2022: decision against booking.com for misleading scarcity messages on accommodation listings (the "booked X times in the last 24 hours" pattern), with a fine in the millions of forints.

Which patterns commonly fail this check?

Shopify apps in the "urgency and scarcity" category often default to behaviour that resets on reload. Apps like Hurrify and Foursixty have been called out in compliance literature for exactly this. WooCommerce plugins in the same space are configured manually and frequently end up in the same shape.

Stock counter widgets that show "only 3 left" without being bound to real inventory data are the same violation in a different form. The text is false, and the falsehood is per se unlawful under Annex I.

Audit every countdown widget on your store. If the timer is bound to a real campaign end date stored server-side, it is defensible. If the timer is bound to the visitor's session or to the page load, remove it or replace it with a real deadline. The two-minute fix prevents the AGCM-shaped fine.
